Welcome to MCLGames. We urge you to carefully read and understand our Terms of Service. Below, you will find a comprehensive outline of all the clauses included in our Agreement. By registering on MCLGames, you acknowledge and agree to comply with our Terms of Service, Privacy Policy, and Game Rules. These terms govern your use of our Services, Games, and software. We reserve the right to modify these terms at any time, and will notify you of any changes via your registered email. Continued use of our services after such modifications implies your acceptance of the revised terms.

 Warranty Disclaimer

MCLGames strives to provide accurate, reliable, and up-to-date information. However, we make no guarantees regarding the completeness or accuracy of the content available on our platform. All information is provided “as is,” without any warranties, whether express or implied. MCLGames disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, error-free service and are not responsible for any technical issues that may arise.

 Use of Software

Our software is intended solely for personal entertainment. Commercial use is strictly prohibited. Users are forbidden from attempting to modify, decompile, reverse-engineer, or disassemble the software. The use of artificial intelligence, including robots, is not permitted. All actions taken within the games must be executed personally by the user using the interface provided.

 Password Security

Your account security is of utmost importance. After registration, it is your responsibility to keep your password confidential. MCLGames is not liable for any unauthorized access to your account resulting from the sharing of your password.

 Eligibility and Jurisdiction

Age Requirement: Participation in MCLGames contests is restricted to individuals aged 18 or older.

Residency Requirement: Only residents of India are eligible to participate.

State Restrictions: Residents of Assam, Andhra Pradesh, Odisha, Telangana, Nagaland, and Sikkim are prohibited from participating in paid contests due to local laws.

Email Requirement: A valid email address is required for registration.

 Breach and Consequences

In the event of a breach of our Terms of Service, MCLGames reserves the right to take appropriate action, including but not limited to:

  1. Restricting games between users suspected of collusion or cheating.
  2. Permanently freezing the user’s account.
  3. Seizing funds in the user’s account.
  4. Taking legal action to recover damages.
  5. Barring future registrations on the platform.

Our decisions regarding breaches are final and binding.

 

 Governing Law and Dispute Resolution

This Agreement is governed by the laws of India. All disputes shall be subject to arbitration under the Indian Arbitration and Conciliation Act, 1996. The exclusive jurisdiction for any legal action related to this Agreement lies with the civil courts of New Delhi.

 Content Ownership and Use

All content on the MCLGames platform, including text, images, logos, and software, is protected by intellectual property laws. By using our services, you grant MCLGames the right to use any content you submit, including chat messages, emails, and game-related data. MCLGames is not responsible for third-party content linked on our website and does not endorse such content.

 Contest Formats

MCLGames offers two contest formats:

Public Contests: Open to all users with a pre-specified number of participants. If the required number is not met, the contest will not operate, and entry fees will be refunded.

Private Contests: Users can create and invite others to join. If the contest does not meet the required number of participants, it may be converted into a Public Contest.

 Indemnity

By using our services, you agree to indemnify and hold MCLGames harmless from any claims, damages, or expenses arising from:

  1. Infringement of intellectual property rights.
  2. Defamatory or illegal conduct by other users.
  3. Misuse of your account.
  4. Technical issues or data loss.
  5. Unauthorized access to your account.
 GST Deduction Policy

GST: A 28% GST is deducted from deposits and credited back as discount points, which can be used within 90 days.

Usage: Discount points cover entry fees and game-related expenses. Points from cancelled matches are returned to your account.

 Wallet Top-up and Withdrawals

All deposits are final. Refunds are only considered in case of transaction errors and are subject to review. Refund requests must be submitted within three working days of the transaction.

 Legality

Playing games of skill is legal under Indian law, including the Public Gambling Act of 1867. MCLGames contests are classified as games of skill, as success depends on knowledge, strategy, and player expertise.

 Fantasy Score and Feeds

MCLGames relies on third-party providers for score feeds and statistics. In case of errors, we will attempt to rectify them before distributing prizes. However, MCLGames is not responsible for inaccuracies in third-party data.

 Bonuses and Promotions

Free Bonus: User’s will get the 10,000 Bonus in account registration.

Instant/Deposit Bonus: We are giving 50% Extra Real Cash back amount on First Deposit.

Referral Bonus: For Every referral, We are giving 1,000 as a Cash Bonus and You can used this bonus for joining the paid contests.

Free Money Prize: Play without an entry fee and win cash prizes.

 Prizes: Terms and Conditions

Multiple Prizes: Users can win multiple prizes in a day.

Notification: Winners are notified via email within 24 hours of match completion.

Taxes: Prizes are subject to TDS, and winners are responsible for any additional taxes.

 
RETURN, REFUND & CANCELLATION POLICY

a) In the event, that there is an error in the Services provided by us, we may refund the Entry Fee, provided the reasons are genuine and proved after investigation by MCL GAMES. 

b) Please read the rules of each Mobile Game and Contest before participating. 

c) We do not cancel registrations once entered, however, in case of exceptional circumstances wherein the fault may lie with the payment gateway or from Our side, We will cancel your participation on request and refund the Entry Fee to You within a reasonable amount of time. 

d) In case we cancel your participation in any Mobile Game or Contest as a result of this, We  will return Your Entry Fee to You within a reasonable amount of time for You to redeem the same by playing other Contests on MCL GAMES.

e) We will try Our best to create the best user experience for You. If paid by credit card, refunds will be issued to the original credit card provided at the time of purchase and in case of payments made through a payment gateway, payment refunds will be made to the same account. 

Users must use any money in their Account within 365 days. MCL GAMES shall have the right to directly forfeit any such unused amount after 365 (three hundred and sixty five) days.  The idle Balance amount lying in your account may be withdrawn only in exceptional circumstances, determined on a case to case basis on the sole discretion of MCL GAMES.

 
Game of Skills and Safety Precautions for Responsible Gaming

The following are an integral part of the terms of use between MCL GAMES and you:

1 . All the Mobile Games hosted by MCL GAMES on the Platform, where a user needs to pay a participation fee in the form of money, are Games of Skill (defined below). Different Mobile Games will reward different skills, but each game will reward certain skills, such as knowledge of the game, familiarity with rules, experience, reflexes, practice, hand-eye coordination, etc. Certain games may have predetermined outcomes (Sudoku, Crosswords, Brick Breaker, etc), which are achievable by the Users using their skills to play the games within the games’ time limits.

2 . Users must note that all Mobile Games available on MCL GAMES are games where the success and/or performance of the Users depends predominantly upon their superior knowledge, training, attention, experience and adroitness (‘Games of Skill’) in playing the game. ‘Games of Skill’, under Indian law, are excluded from the ambit of gambling legislations including the Public Gambling Act of 1867 and other state enactments except in the Restricted States. 

3 . Hence, the individuals residing in the Restricted States should not participate in any paid Contests/tournaments/other gameplay formats or Mobile Games offered on the Platform. Any participation by such individuals shall be at their sole risk and discretion and MCL GAMES shall not be liable to refund or reimburse any injury or damages suffered by such individuals.

4 . MCL GAMES reserves the right to monitor all activities from the User’s Account on the Platform. If any User participates in any Contest or Mobile Games in violation of any central and/or state law(s) in India, MCL GAMES reserves the right to cooperate with law enforcement agencies of the relevant state and report such participation and/or suspicious activity along with all relevant details of the concerned User.

5 . MCL GAMES does not support, endorse or offer to any User ‘games of chance’ for money. Each Mobile Game and Contest available on the Platform has clearly defined rules and code of conduct. All Users are encouraged to read, understand and follow these rules to be successful in these games. MCL GAMES shall not be liable if Users do not adhere to the Game Rules or otherwise do not adhere to MCL GAMES’s Terms of Service.

6 . MCL GAMES suggests that Users adopt a balanced approach while engaging with any of the Mobile Games on the Platform and be mindful of gaming within their means and limits. If played optimally, Mobile Games (like other forms of sports) aim to encourage Users to develop their mental prowess, hand-eye coordination, competitiveness and encourage teamwork.

7 . You should take certain standard health and safety measures while playing any Mobile Game, including taking adequate breaks, sitting at a reasonable distance from the screen, playing in a well-lit environment, and avoiding playing when tired, drowsy, intoxicated or under the influence of substances. Avoid playing without breaks over long periods of time as this could affect your performance and could adversely impact hand-eye coordination, balance, and multi-tasking ability. 

8 . The Platform or the Mobile Games offered on the Platform may contain flashing lights, realistic images, patterns and simulations which may cause certain side effects. If your hands, wrists, arms, eyes or other parts of your body become tired or sore while playing, or if you feel symptoms such as tingling, numbness, burning or stiffness, stop and rest before playing again. If you continue to have any of these above symptoms, please stop playing IMMEDIATELY and consult a doctor.

9 . If you play any Mobile Games on the Platform, give yourself plenty of room to play and always be aware of your surroundings. While playing any Mobile Game you may be moving around the play area and using your hands to control gameplay. You must ensure that you are not near other people, objects, stairs, balconies, windows, walls, furniture or other objects that may pose a danger to you or could be damaged during the play. Never handle sharp or dangerous objects while playing any Mobile Game on the Platform.

10 . It is your responsibility to control your surroundings and movements at all times when playing the game to ensure that you don’t injure yourself, any other persons, damage any property, etc. Any playing of the Mobile Games is at your own risk and MCL GAMES shall not be liable for any death, injury or health or complications resulting from your use of the Platform.

11 . You agree that your use of the Platform and to play the Mobile Games is at your own risk, and it is your responsibility to maintain such health, liability, hazard, personal injury, medical, life, and other insurance policies as you deem reasonably necessary for any injuries that you may incur while using the Platform.

12 . You hereby agree that if the terms of this Agreement are not adhered by you, MCL GAMES will be irreparably damaged, and therefore you agree that the Platform shall be entitled, without bond, other security, proof of damages, to appropriate equitable remedies with respect to any breach of this Agreement, in addition to any other remedies available under Applicable Law.

 
TDS POLICY

In line with the provisions contained in Finance Act, 2023, following TDS policy is applicable for all players on MCL Games from 1 Apr, 2023.

  • TDS is applicable at the time of withdrawal or deposit refund
  • 30% TDS is applicable on any positive net winnings at the time of withdrawal
  • TDS is also applicable at the end of financial year on year end wallet balance by considering it as a withdrawal amount. Post applying TDS on the remaining balance (as per policy), the remaining amount will be carried forward to the next financial year as deposit balance. Carried forward balance will be considered as investment for next year and TDS would not be applicable for that amount.
  • Here, Net winnings = Total Withdrawals – Total Deposits (in a financial year). Apr 1 to Mar 31 duration is considered a financial year.

How Was TDS Deducted Before Apr 1, 2023?

  • Before Apr 1 2023, TDS was deducted at a game level when the winnings were greater than 10K.
  • Example: Previously if I won Rs 11000 in a game, then 30% TDS will be deducted i.e. 3300 and hence Rs 7700 will be credited in the withdrawal wallet. 

How Is The Current TDS Policy Different From The Last TDS Policy Of FY 2022- 2023?

  • Post Apr 1, if I win some amount let’s assume Rs 11000, NO TDS will be deducted while crediting that amount in the withdrawal wallet. Entire Rs 11000 will be transferred to the winnings wallet.
  • Only when the user will try to withdraw any amount from the wallet, we will look at the net winnings and basis that calculate the TDS applicable.
  • Hence we will deduct TDS only when the withdrawal running total is more than the Deposits. If the user is in loss, there will be no TDS. Hence this will be beneficial to the users.

Please note that the TDS Policy is based on the understanding of the provisions as introduced/ amended by Finance Act, 2023 and the Company reserves its right to modify/ change/ amend the TDS Policy basis law applicable at the relevant time. Attached is the finance bill amendment which says that the policy will be applicable from Apr 1, 2023 rather than July 1, 2023 (Refer to Page 10, Row 31 and 32).

Conclusion
